1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Scolar Nepal (the "Platform", "Scolar", "we", "us"), including our website, catalog, checkout, and account features. By browsing the Platform, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Who Can Use Scolar
You must be at least 18 years old, or using the Platform under the supervision of a parent or guardian, to create an account or place an order. Information you provide during registration or checkout — including your name, phone number, email, and delivery address — must be accurate and kept up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Products & Listings
Scolar lists textbooks, reference books, general literature, stationery, and related academic materials sourced from authorized publishers and distributors. Product images, descriptions, and edition details are provided for reference; minor variations in cover design or edition print run may occur between what is shown and what is delivered, consistent with publisher revisions. Availability of any listed item is not guaranteed until your order is confirmed.
4. Orders & Order Acceptance
Placing an order is an offer to purchase, which Scolar may accept or decline at its discretion — for example where an item is out of stock, a listing contains a pricing or description error, or we suspect fraudulent activity. We will notify you if an order cannot be fulfilled and, where payment has already been collected, issue a refund to the original payment method or store credit as applicable. An order is only confirmed once you receive an order confirmation from Scolar.
5. Pricing & Payment
Prices displayed at checkout are in Nepalese Rupees (NPR) and reflect the publisher's Maximum Retail Price or an authorized promotional price, as set out in our Disclaimer. We accept Cash on Delivery (COD) and digital payments through authorized Nepalese payment gateways (eSewa, Khalti, and bank transfer). By choosing a digital payment method you agree to that gateway's own terms; Scolar does not store your card or banking credentials, as described in our Privacy Policy. Prices and promotional discounts may change without prior notice and do not apply retroactively to orders already placed.
6. Shipping & Delivery
Scolar delivers across all 77 districts of Nepal. Estimated delivery timelines shown at checkout are best-effort estimates, not guarantees, and may be affected by courier availability, weather, regional access, or public holidays. Risk of loss or damage passes to you upon delivery to the address provided at checkout; please inspect your package on arrival and report any issue promptly using the process below.
7. Returns, Exchanges & Cancellations
Damaged, defective, or incorrectly shipped items are covered under our 7-Day Return & Exchange Policy, which forms part of these Terms. Orders may be cancelled before dispatch by contacting support; once an order has shipped, cancellation is treated as a return under that policy. Books showing wear, writing, or damage caused after delivery are not eligible for exchange.
8. Account Responsibilities & Prohibited Use
You agree not to use the Platform to: violate any applicable law; impersonate another person or misrepresent your affiliation; place fraudulent orders or abuse promotional offers; attempt to access another user's account or non-public areas of the Platform; or interfere with the Platform's normal operation (including scraping, automated order placement, or attempts to bypass security controls). We may suspend or terminate accounts that violate these Terms.
9. Reviews & User Content
Where the Platform allows you to submit reviews, ratings, or comments, you retain ownership of that content but grant Scolar a non-exclusive, royalty-free license to display, reproduce, and distribute it in connection with the Platform. Submitted content must not be defamatory, unlawful, or infringe a third party's rights; we may remove content that violates this section without prior notice.
10. Intellectual Property
Book titles, cover art, author biographies, and publisher trademarks displayed on Scolar remain the property of their respective publishers and rights holders, as described in our Disclaimer. The Scolar name, logo, and the Platform's own design, text, and software are the property of Scolar and may not be copied or reused without our written permission.
11. Limitation of Liability
The Platform is provided "as is." To the fullest extent permitted by law, Scolar is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, delays in delivery outside our reasonable control, or reliance on academic/syllabus information that is subject to change by the relevant educational board. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
12. Indemnification
You agree to indemnify and hold Scolar harmless from claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Platform.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The "Last updated" date above reflects the most recent revision. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of Nepal. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
